vibe senderTerms of Service
These terms govern the use of Vibe Sender (vibesender.io and app.vibesender.io), operated by JPL DIGITAL LTDA, a company registered in Brazil under CNPJ 44.004.861/0001-13 ("JPL Digital", "we"). By creating an account or using the service, you agree to them on behalf of yourself and the business you represent.
1. The service
Vibe Sender is a platform for businesses to talk to their customers. It offers a shared inbox for WhatsApp, Instagram and email, a CRM, automations, broadcasts of approved WhatsApp templates, AI agents, and ad attribution reports. The service works through your own accounts on third-party platforms, using their official APIs. Fees that Meta charges for WhatsApp conversations are billed by Meta directly to you and are not part of your subscription.
2. Your account
You must be at least 18 and able to act for the business. You are responsible for keeping your credentials safe, for the people you invite to your team, and for everything done through your account.
3. Plans, trial and payment
- New accounts get a free trial. A payment card is required, and the first charge happens when the trial ends unless you cancel before.
- Plans are billed in advance, monthly or yearly, through Stripe, in the currency shown when you subscribe. Subscriptions renew automatically until cancelled.
- Prices in euros exclude VAT. Plans in euros are only for businesses with a valid VAT number; VAT is reverse-charged. Other taxes may apply according to your location.
- You can cancel at any time in the app. The cancellation takes effect at the end of the paid period, and paid periods are not refunded, except where the law requires otherwise.
- Plans include limits on channels, team members and AI usage. We may suspend the service after a failed payment that is not settled.
4. Acceptable use
- You must comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, Instagram's Terms and Platform policies, anti-spam laws and data protection laws, including the LGPD and the GDPR.
- You may only message people you have a lawful basis to contact, and you must honor opt-out requests promptly.
- Spam, harassment, deception, illegal content, or messaging purchased or scraped lists are prohibited. They may lead to immediate suspension, and they may cause Meta to restrict or ban your own WhatsApp number or Instagram account, which is your responsibility.
- You may not reverse engineer, overload or resell the service without our written permission.
5. Your data and your contacts' data
Your data and your contacts' data belong to you. For your contacts' data, you are the controller and JPL Digital processes it only to provide the service, as described in the Privacy Policy. You are responsible for having the rights and consents needed to upload and process it.
6. Third-party platforms and AI
The service depends on Meta, Stripe, OpenAI, Resend and other providers. Outages, policy changes, message holds or account restrictions applied by them are outside our control. Answers generated by AI features may contain mistakes; you are responsible for reviewing how the AI agent is set up and what it sends on your behalf.
7. Availability and liability
The service is provided "as is". We work to keep it available and secure but do not guarantee uninterrupted operation. To the extent permitted by law, we are not liable for indirect damages or lost profits, and our total liability is limited to the amount you paid for the service in the 3 months before the event.
8. Termination
You may stop using the service at any time and request deletion of your data (see the Privacy Policy). We may suspend or close accounts that violate these terms or the policies of the connected platforms.
9. Changes
We may update these terms. The date above always shows the current version, and important changes will be announced in the app or by email.
10. Law and jurisdiction
These terms are governed by the laws of Brazil. Disputes will be settled in the courts of JPL Digital's registered office, unless the law gives you the right to another forum.
